Bennett Valley Homeowner's Association Changes Meeting Time, This Month's Meeting Place, Possible Name Change

Meeting Time And Day

BVHA has been changing meeting times, between 7:00 and 7:30 pm, depending on whether or not a speaker was scheduled, with the result that even the Board members weren't always sure what time each meeting started We've decided to have all of our meetings start at 7:00 pm, with or without a speaker. Also, as a reminder, for 2005 our meetings have been changed to the third Tuesday of the month, rather than the third Wednesday.

March 15™H Meeting At Bv Grange Hall

Our next meeting will be at the BV Grange Hall, rather than the BV Fire Station. We are considering moving our meetings permanently to the Grange Hall, and that will be decided at this next meeting. As one of our Board members, Marilyn Stocks, has stated, "The Grange has been a gathering place in the Valley for over 100 years so why not use it?...They [the BV Grange] welcome the plan and feel very positive about our meeting there."

Shall We Change Bvha'S Name? What Is A

GOOD ALTERNATIVE NAME? Your input on this would be greatly appreciated, especially before our next meeting on March 15th. Do you feel we should change our name? What alternative names sound good to you? Again you can contact one of the Board members by telephone, email, FAX or by letter (see Page Six) with your opinions and suggestions.

To quote the minutes of our last meeting on January 18th, 2005, "There are two purposes to consider changing the name of BVHA; 1.) Legitimate "homeowner associations" involve mandates for all of the homeowners in a specific geographical area including [required] membership; BVHA does not [have the authority to] require anything of homeowners or parcel owners in the Bennett Valley area. 2.) To make it clear that BVHA is not just for homeowners in Bennett Valley; parcel owners who do not have homes in Bennett Valley are also included as potential voting members in this Association...Lolly [Mesches] and Frank[LaCombe] will write opposing view articles in the next VOICE."

Reasons To Change The Name

by Frank LaCombe In September 2004, the San Francisco Chronicle featured an article on Homeowner Associations and the legal baggage that the term "Homeowners Association" now implies; surrender of control to a small group of people, loss of individual rights. In the intervening years since its founding, the BVHA has not been embraced by everyone for some of these same suspicions and resentments. This has only been compounded by recent clashes.

Unfortunately, because of its former close alliance and strong support of the Bennett Valley Design Review Committee, the BVHA finds itself still too closely associated with that divisive period - despite recent claims of a divorce with the past and a new openness, a new transparency. Yet mistrust and misinformation still exist on all sides, as seen at our November meeting.

Now, a new opportunity exists to make a clean break from the past and to free ourselves from the stigma attached to "Homeowners Associations". Change the name of our organization. Certainly there must be enough goodwill, open-mindedness, as well as creativity in the valley to come up with a less bureaucratic sounding name for our group.

All of us are admirers, supporters and advocates of the pastoral stewardship of Bennett Valley. Can we evolve into a new organization that reflects the natural serenity of the valley? A new name? I hope so. I'm open to any ideas from the simple "Bennett Valley League" to the loftier "James Bennett Society", or whatever. Please think about this fresh perspective. Give us your thought and ideas.

We are at an impasse with strongly held viewpoints. Can this be mediated? I believe we've sincerely tried. One way to deal with this problem may be through use of humor. Bennett Valley Rural Mail Theft

In December, 2004 mail was stolen from at least ten mailboxes on Bennett Ridge late one Monday evening. Those mailboxes which had padlocks on them were also broken into, with the padlocks either sawed off or the mailbox doors pried open, and the mail removed. Two days later on Bennett Ridge, a couple who had just returned from vacation were waiting for their mail which the post office had stored for them while they were gone.

By 6:30pm their locked mailbox door had been pried open and all their mail was stolen. This included some of their personal checks, which the thieves used and a Penney's credit card, which later had $3,000 worth of merchandise charged on it. Both law enforcement and the post office told them that rural mail theft is common and lately, Bennett Valley is being hit hard. Rural mail theft happens at least once or twice a year on Bennett Ridge.

One of the Bennett Ridge households since purchased a Letter Locker, which doesn't absolutely prevent mail theft but makes it much more difficult. We may have even picked up trash in front of your property. This isn't a strenuous chore! There are many easy-to-walk roadsides with level footing that you can select to spruce up.

Clean your favorite stretch of road and drop the filled bay back at the fire station on either Saturday or Sunday. We won't have coffee and donuts for you during the week like on Saturday, but you'll have our heartfelt thanks!

SR Firefighter Saves Woman From Blaze While this didn't happen in Bennett Valley, it was our Bennett Valley Fire Chief, Andy Pforsich, who accomplished this tremendous rescue, in his role as Battalion Chief for the Santa Rosa Fire Department. "...Andy Pforsich kicked open the door of a burning apartment Tuesday and heard a moan but saw nothing but smoke. He dropped to the floor and crawled until he felt a leg. Pforsich, who wasn't wearing any breathing apparatus, dragged 65-year old Jacqueline Camp to the door and safety....[He] was treated for minor smoke inhalation after the blaze was contained. He returned to duty later in the day." (Press Democrat, January 12", , 2005) And he attended our monthly BV Fire Board meeting that same evening, January 11th. This week he was given the Medal of Valor by the City of Santa Rosa for his brave and life-saving actions. As has been said before, Andy is doing an outstanding job for Bennett Valley, both administratively and in supervising and leading our firefighters.

Community Meetings at the BV Fire Station The following letter, written by Chief Pforsich, was sent to 12 local community groups, including Bennett Valley Homeowner's Association, Bennett Ridge Mutual Water Co., Holland Heights Association, Summit View Ranch and Yulupa (Woodside) Water Company: "An increase in the number of firefighters on duty at the fire station at any given time has created a conflict between firefighters' use of the living/dining area during dinner time and early evening hours and scheduled community meetings. There are often four to six personnel on duty because of additional paid staffing, brought about by special tax revenue, and volunteers who choose to spend their free time at the fire station. While I'm grateful for, and proud of, increased staffing and all-time high morale and participation, the community meeting schedule must be adjusted to provide for firefighters' basic needs.

An agendized discussion was held at the regular meeting of the Board of Directors on Tuesday, February 8t. When a community meeting is scheduled in advance, enough fire engines will be moved out and the heat will be turned on early enough (4pm?) so that the room will be sufficiently warm without too much noise from the heater fans. The Fire Board was able to have a successful meeting there on 2/8/05, with enough warmth and not too much noise.] Clearing Driveways by Andy Pforsich Our firefighters, and the engine they're riding in, are only as good as their ability to reach your property in a timely manner. For those property owners who live on or at the end of a driveway, whether paved or gravel, it is imperative that the surface is maintained to accommodate a 20-ton fire engine. Of equal importance is providing adequate clearance above and alongside the driveway. Twelve feet high and wide is recommended which allows for some regrowth, while not impeding access. If a fire engine breaks through the surface and becomes stuck, or if firefighters have to trim trees to allow access while responding to an emergency, the delay may cause an entirely different and undesirable outcome.

You may call the fire station and arrange for the crew to pay a routine visit to your property to evaluate your access prior to an emergency response. BV Firefighter Activities, January & February By Bryon Reid, 24-Hour Shift Firefighting Engineer Vehicle Accidents: 6 Fire Alarms: 3 Medical Aids: 6 Structure Fires: 2 Hazardous Conditions: 4 Smoke Investigations: 1 The months of January and February have been slow months in terms of emergency responses. As one can see, due to the weather we have recently been experiencing, the number of vehicle accidents has increased. This is, in large part, due to slippery roads and drivers driving too fast for the conditions. It is fortunate to report that none of these accidents resulted in any serious injuries or damage to people and property. Also, we have had an increase in Hazardous Conditions incidents. A Hazardous Condition is typically a tree down blocking the roadway or a power line down. Any situation creating a hazard to the public will be taken care of by the Fire District or they will contact the appropriate agency. As always, the best thing to do when coming upon a Hazardous Condition is to protect yourself, dial 911 and be sure you give the dispatcher accurate information.

Grange Road Bridge Update by Jim Alfieri, Sonoma County Bridge Engineer On the morning of Tuesday, February 7*h, , the latest generation of the Grange Road Bridge entered this world, weighing in at a strapping 2,400,000 pounds. Supported by 56 sturdy legs, the structure became

complete when the designed 13,000,000 pounds of on the best that Bennett Valley traffic has to offer. pre-stressing muscle was applied to its frame. But now we need some approach roadway. The concrete for the superstructure has been put in place. And after 10 days of curing and achieving a strength of 3,600 pounds per square inch, the 13,000,000 pounds of force were applied to the abutments and transferred throughout the length of the superstructure. (Do recall the analogy of squeezing a horizontal stack of books at its ends to carry them across a room. This is the same system, just different magnitudes.) Would you like some more specifics on how this is done? Applying 13,000,000 pounds of force? You have an enhanced technical interest?? Be happy to oblige. If not, you have our permission to skip this next paragraph. No hard feelings.

Thus the next phase of the project, now underway, is constructing the roadway approaches. includes the embankments and the four approach retaining walls that contain the embankments. Two of the approach retaining walls are complete. In conjunction with the north-end embankment work, SBC is in the process of relocating their telephone wires and equipment underground, beneath the embankment. For customers south of the project the wires and equipment will be housed within the new structure as it crosses Matanzas Creek.

Three hundred (300) high strength 0.6 inch diameter wire strands were installed through two hollow tubes cast in each of the six girder walls throughout the length of the structure. Where the strands exited at the far end (dead end), anchor blocks and wedges were placed to grip the strands tightly against the structure. At the entrance end (jacking end), a hydraulic jack sequentially and individually gripped onto each of the twelve clusters of strands and by pushing against the superstructure, elongated the strands up to the needed 12 inches and then released. Wedges and anchor blocks were in place also at the live end so when the jack was released the strands were trapped in this elongation mode and the forces developed were transferred throughout the superstructure. One of many interesting side notes is Everything coming up seems routine. Right??

Well there is still a little more fun that yet awaits us. At the approaches, in the area back where the present detour alignment overlaps with the soonto-be built final alignment, this area must figuratively change shape, geometrically and vertically, in one continuous operation, while absorbing the normal traffic flow, to get the traffic from the detour to the final alignment. In the best of worlds, the ideal situation would be to detour traffic away from the work, then proceed to eliminate the detour alignment and finalize the construction of the final configuration. Swift, quick and easy. However, with or without a detour, the work will be performed with the highest concern for the traveling public; their convenience and their safety. Again we appreciate, especially during this period of transition construction, your continual display of caution and courtesy.

Informal chit chat amongst these groups has commenced. More to come on this, when an actual final date can be accurately defined.

The question is, what will they do if there is a known problem? Arsenic is a big issue, as 40% of the wells in the county have naturally-occurring arsenic in the water.

During the year we're planning to schedule a speaker from the Sonoma County Water Coalition, someone from PRMD to explain the Design/Review Process, and a speaker on solar energy. Bobbie and Lolly will work on new guidelines to follow the spirit of the Brown Act, even though it is no longer mandatory that BVHA comply with that act.

Brief Summary, BVHA Board Meeting January 18", 2005 Public Input: Suzanne Dougherty brought up the possibility of a celebration for the Grange Road Bridge when it is completed. It was also brought up that we have more frequent police patrols and if you see someone speeding regularly you can get a better response if you call the Highway Patrol, directly.

County Action: The name on Molinari Road has been changed to Matanzas Creek Lane. The BV Fire District and the dispatch service were not informed about this change, which could have proven to be dangerous in an emergency. A message was sent to Valerie Brown on 1/13/05 and her response follows: "l have had problems from day one with the street name changes and didn't know they were taking place - especially concerned if the reason they cited they needed to make the changes (fire safety) didn't even get to those people.../ will talk with the Sheriff and Fire Chief as well as PRMD..." Old Business: Frank LaCombe made a report on the meetings of Sonoma County Water Coalition, which he had attended. This organization is concerned that the public may not be aware of all the well problems in rural areas. They are starting a media campaign in various papers to inform people, but this campaign requires money. The BVHA Board agreed to contribute $200 for this media campaign, once we received some additional information from Frank about the Sonoma County Water Coalition.

Michael Friedenberg reported that the County is in the process of revising a thirty-year old well ordinance. The new tests now require collection of data over a longer time period. While we do not intend to be real precise about using Robert's Rules of Order, some confusion over the last few months about the correct procedure on the highlighted subjects below has resulted in research about the following "rules": To make a main motion, a Board director is recognized by the Chair...when no other question is pending and when business of the kind represented by the motion is in order...After a motion has been made, another member who wishes it to be considered says, "I second the motion"...A second merely implies that the seconder agrees that the motion should come before the meeting and not that he necessarily favors the motion...When a motion is in order and has been made and seconded, the chair formally places it before the Board by stating the exact motion and opens it to debate...lt will frequently happen that the (Board) -although it desires to take some kind of action on the subject...wishes to make greater or less change in the proposal before voting on its adoption. 1.) Minor modifications can be suggested by another Board member before the question is stated, which may be accepted or rejected by the maker. 2.) After the question has been stated by the chair, then the Board and not the maker of the motion then has control over its wording. Either the maker can get unanimous consent to change his original motion or another Board member can make a motion to amend the motion, with a second, which is then debatable and can be adopted by a majority vote.
